On a subsale purchase, get the house inspected before you sign the SPA, price each defect from real repair costs, and use that list to ask the seller to repair, reduce the price or disclose in writing. A subsale is not protected by the Housing Development Act's defect liability period: once you complete, the repairs are yours. A written, itemised list of defects with repair costs turns the negotiation into arithmetic. What the HDA does not cover on a subsale

If the seller will not allow an inspection before the offer, ask for the letter of offer to state that the purchase is subject to a satisfactory inspection before the SPA. Ask your solicitor how to word it.

What an inspection finds that a viewing misses

A viewing is short, often in the evening, with the seller or agent present and the furniture in place. A proper inspection is slower and tests things. It runs water in every wet area and watches where it goes, reads the water meter with everything off, taps floor tiles for hollowness, checks every socket and the RCCB, looks into the roof space of a landed house, and checks ceilings, window heads and external walls for signs of water. What the report should give you

  • A numbered list of defects with the room, the exact location and a photo reference for each.
  • A note of what was tested and how, and what was found sound.
  • A severity mark for each item: urgent, significant, or cosmetic.
  • A short description of the likely repair, so it can be priced.
  • Items that need a specialist, such as a structural engineer or termite treatment, clearly flagged.

A report that only lists "water stains" or "cracks" without location and cause is hard to price and easy for a seller to dismiss.

Add the items up as a range, low and high, and keep the source beside each line. A buyer who can show where each figure comes from is far harder to wave away than one who says the house "needs a lot of work".

Repair, reduce or disclose: the three asks

With a priced list you can make one of three requests, or a mix of them:

  • Repair before completion: the seller fixes named items before handover. Name the method, not just the item, and ask to re-check the work before completion.
  • Reduce the price or credit the cost: the bought-house guide suggests negotiating a price reduction or a credit in the SPA to cover repair costs. This leaves the repair in your hands, which is often better.
  • Disclose in writing: ask the seller to confirm known defects in writing. If they deny a problem the report found, that written answer matters later.

Sellers respond better to a short, priced list of significant items than to a long list of cosmetic ones. Lead with water, structure, roof and electrical items, and keep paint and minor finishes for last.

When the report says walk away

Some findings change the decision rather than the price: signs of structural movement that need an engineer's opinion, widespread water damage across several rooms, or major unapproved extensions. In those cases, get the specialist's view before you commit. The cost of a short delay is small compared with buying a problem that the price reduction does not cover.

After you buy: planning the repairs

Whatever you agree, the report becomes your repair plan. Do the water and electrical items first, before any renovation covers them. Keep the report with your purchase documents: if a defect turns out to have been concealed, it is part of the record of what was visible on the day.
